You can as a “Visitor” travel through most of our company web site without giving us any information about yourself. But sometimes we do need information from you to provide information and services that you request.
We use your personal information for four primary purposes:
Any information you provide while visiting the Apptimate site will be used by Apptimate or an authorized Apptimate Partner only. We will not share your information with any other organization or party. You will only be placed on mailing lists if you register for them.
Apptimate may provide discussion forums, blogs, or chat rooms on the Company’s Web site. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Apptimate is not responsible for the personal information you choose to submit in these forums.
Apptimate may post a list of Customers and testimonials on the Company’s Web site that contain information such as Customer names and titles. Apptimate obtains the consent of each Customer prior to posting any information on such a list or posting testimonials.
When expressing an interest in obtaining additional information about or registering for the Service as a “Developer”, you might be required to provide the Company with personal contact information, such as name, company name, address, phone number, and email address (“Required Contact Information”). This information will not be shared with any other organization. It will be used only by Apptimate to send you news about our company and our products.
When purchasing the Services as a “Developer”, Apptimate requires you to provide the Company with financial qualification and billing information, such as billing name and address, credit card number, VAT number, etc. (“Billing Information”). Apptimate may also ask you to provide additional information, such as company annual revenues, number of employees, or industry (“Optional Information”). Required Contact Information, Billing Information, and Optional Information are referred to collectively as “Data About Apptimate Customers.”
We also collect Third Party API Access Protocols as provided in the Section headed “Our Relationship with Social Networking Sites and Third Party Data Providers”.
We only store and handle a minimum of End User Information. We do not want it since that could increase the risk for your app and your users. We do not want it since it is your data.
However, if a Developer collects and submits to us information of End Users, either through an Application or otherwise, we may receive and store such information (“End User Information”). It is the Developers full responsibility without limitation to get the End User Approval for collecting, handling and storing such information. Apptimate accepts no responsibility for what information the Developer collects or how the End User Information is acquired or handled in the Application.

We also use Personal Information to contact you and provide you with information that may be useful or interesting to you, including operational status of the Service, newsletters regarding changes and upgrades to the Services as well as promotional e-mails, and to allow certain other entities to do the same. By using the Site, you agree to receive this information from us and certain other entities. If you do not want to receive these communications, you can always opt out of communications by following the instructions provides in the email. We may, however, send certain administrative emails which pertain to the Site and Services on a regular basis that you may not opt-out of.
We may also use Personal Information to create Anonymous Information records by excluding information that makes the information personally identifiable.
Apptimate will disclose your Personal Information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Apptimate, the Services or the Site; (b) protect and defend the rights or property of Apptimate; 8c) to enforce our Terms of Service, and, (d) act in urgent circumstances to protect the personal safety of users of Apptimate Services, its Web sites, or the public.

We reserve the right to disclose Anonymous Information publicly without restriction, including to third party vendors who may help us enhance or provide the Site or Services or to third parties.
We have created and may offer you interfaces that allow you to connect with social network (“SN”) websites such as, but not limited to, Facebook through our Web Site and Service. We will work with their application protocol interface (better known as their developer API) in a way that allows you to authorize us to access your account on that SN Service on your behalf. In order to provide this authorization, you will not provide us with your user ID or password to the SN, but you will need to log-in to that SN directly through our Site. Once authorized by you, the SN will provide us a token that allows the SN to recognize us when we ask, on your behalf, for access to your account information or to post information. You will be able to revoke our access to any SN at any time by amending the appropriate settings from within your account settings on the applicable SN, though such revocation may limit the Services we are able to provide you.
In addition to accessing your SN accounts through Developer APIs, we may also offer interfaces that allow Developers to connect with APIs for SN as well as other third party data providers in a manner that allows a Developer to retrieve data from such third parties for inclusion in a Developer’s App, for example Facebook or Google Maps (collectively, “Third Party Data Providers”). We may connect Apps to such APIs using the token method discussed above or we may require that a Developer provide us the applicable API key, user name, password or other method of authentication (the “Third Party API Access Protocols”). The Third Party API Access Protocols will be disclosed and used in the same manner as Personal Information, with the understanding that they will not be used to market any products or services.
Please note that even though you may cancel your account or in other ways request the deletion of your Personal Information by us, we may be required (by law or otherwise, such as to prevent fraud, resolve disputes, troubleshoot problems, or enforce our Services Agreement) to keep this information and not delete it (or to keep this information for a certain time) in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete Personal Information, it will be deleted from the active database, but may remain in our archives and we may also retain Anonymous Information about your use of our Services. Once we disclose some of your Personal Information to third parties, we cannot access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.
We employ reasonable physical, electronic and managerial security methods to help protect against unauthorized access to Personal Information. However, no data transmission over the Internet or data storage facility can be guaranteed to be perfectly secure. As a result, while we try to protect your Personal Information, we cannot ensure or guarantee the security of any information you transmit to us, and you do so at your own risk.
