Privacy Policy

At Apptimate, we are committed to protecting your privacy.

Apptimate offers a variety of services that are collectively referred to as the “Services.” Apptimate collects information from individuals who visit the Company’s Web site (“Visitors”) and individuals who register to use the Services (“Developer”).  Visitors and Developers are individually referred to as a “User,” and collectively, as “Users”. This Privacy Policy also applies to information collected through Apps from end users of those Apps (“End Users”), as described in more detail below.

BY USING OUR SITE OR SERVICES OR SUBMITTING PERSONAL INFORMATION THROUGH OUR SITE OR SERVICES, YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY AND YOU EXPRESSLY CONSENT TO THE PROCESSING OF YOUR PERSONAL INFORMATION ACCORDING TO THIS PRIVACY POLICY. YOUR PERSONAL INFORMATION MAY BE PROCESSED BY US IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.

THE APPTIMATE WEBSITE

You can as a “Visitor” travel through most of our company web site without giving us any information about yourself. But sometimes we do need information from you to provide information and services that you request.

We use your personal information for four primary purposes:

  • To make the site easier for you to use by not making you enter your personal information more than once.
  • To help you quickly find information.
  • To help us create and deliver content most relevant to you.
  • To alert you to product releases, special offers, updated information and other news from Apptimate.

Any information you provide while visiting the Apptimate site will be used by Apptimate or an authorized Apptimate Partner only. We will not share your information with any other organization or party. You will only be placed on mailing lists if you register for them.

Apptimate may provide discussion forums, blogs, or chat rooms on the Company’s Web site. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Apptimate is not responsible for the personal information you choose to submit in these forums.

Apptimate may post a list of Customers and testimonials on the Company’s Web site that contain information such as Customer names and titles. Apptimate obtains the consent of each Customer prior to posting any information on such a list or posting testimonials.

THE APPTIMATE SERVICE

When expressing an interest in obtaining additional information about or registering for the Service as a “Developer”, you might be required to provide the Company with personal contact information, such as name, company name, address, phone number, and email address (“Required Contact Information”). This information will not be shared with any other organization. It will be used only by Apptimate to send you news about our company and our products.

When purchasing the Services as a “Developer”, Apptimate requires you to provide the Company with financial qualification and billing information, such as billing name and address, credit card number, VAT number, etc. (“Billing Information”). Apptimate may also ask you to provide additional information, such as company annual revenues, number of employees, or industry (“Optional Information”). Required Contact Information, Billing Information, and Optional Information are referred to collectively as “Data About Apptimate Customers.”

We also collect Third Party API Access Protocols as provided in the Section headed “Our Relationship with Social Networking Sites and Third Party Data Providers”.

END USER INFORMATION

We only store and handle a minimum of End User Information. We do not want it since that could increase the risk for your app and your users. We do not want it since it is your data.

However, if a Developer collects and submits to us information of End Users, either through an Application or otherwise, we may receive and store such information (“End User Information”). It is the Developers full responsibility without limitation to get the End User Approval for collecting, handling and storing such information. Apptimate accepts no responsibility for what information the Developer collects or how the End User Information is acquired or handled in the Application.

End User Information collected through Applications may include, but is not limited to, personal data of technical nature:

  • We provide and store UIDs (Apptimate generated user IDs) and Group IDs related to Application IDs.
  • We do not handle Personal Information about End Users, e.g. name or phone number. However, this kind of information can be sent in messages and thus stored temporarily in our queues.
  • We might offer convenience services like binding some Personal End User data to UIDs. This is optional and must be approved by Developer when selected.

USE OF DEVELOPER INFORMATION

We will use Developer Information to:

  • Administer Accounts;
  • Process your payments, provide the Services and customer support;
  • Tailor the features of the Site or Services to you;
  • Respond to requests, resolve disputes and/or troubleshoot problems;
  • Market our Services and products to our Developers and those of third parties we believe may be of interest to our Developers, including through the serving of targeted advertisements, though we will not disclose your Personal Information in doing so.
  • Improve the quality of the Site and the Services;
  • Verify your compliance with your obligations in our Terms of Use and/or other agreements you may have executed with us;
  • Communicate with Developers about the Site and the Services;
  • Apptimate staff does not access or interact with Apps, Developer or End User data as part of normal operations. There may be cases where Apptimate is requested to interact with such data at the request of the Developer for support purposes or where required by law. Apptimate may also inspect customer data to debug and troubleshoot platform issues.

We also use Personal Information to contact you and provide you with information that may be useful or interesting to you, including operational status of the Service, newsletters regarding changes and upgrades to the Services as well as promotional e-mails, and to allow certain other entities to do the same. By using the Site, you agree to receive this information from us and certain other entities. If you do not want to receive these communications, you can always opt out of communications by following the instructions provides in the email. We may, however, send certain administrative emails which pertain to the Site and Services on a regular basis that you may not opt-out of.

We may also use Personal Information to create Anonymous Information records by excluding information that makes the information personally identifiable.

DISCLOSURE OF PERSONAL INFORMATION

Apptimate will disclose your Personal Information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Apptimate, the Services or the Site; (b) protect and defend the rights or property of Apptimate; 8c) to enforce our Terms of Service, and, (d) act in urgent circumstances to protect the personal safety of users of Apptimate Services, its Web sites, or the public.

We may also disclose certain Personal Information:

  • To third party vendors who help us provide the Services or the Site, including vendors that process payments, or who provide or market additional goods and services, in which case we will require such vendors to use such information in accordance with their privacy policies posted on their websites.
  • To third parties to whom you ask us to send Personal Information, including where a Developer chooses to integrate a third party’s services or content into an App.
  • Apptimate uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on the Company’s behalf.

ANONYMOUS INFORMATION

As you use our Site or Service, we may also collect certain information, including Internet protocol address, browser type, domain names, and access times from you. We also use Cookies and navigational data like Uniform Resource Locators (URLs) to gather information regarding the date and time of your use of the Service. USE OF ANONYMOUS INFORMATION

Generally, we use Anonymous Information in statistical analysis to help us analyze patterns in the use of our Services. We may, through our use of Cookies, keep you logged into the Site during each session. We may also use Anonymous Information to improve our internal operations, surveys and software, and customize the content and layout of the Site and/or Service. We may also, with your consent, combine Anonymous Information with your Personal Information. We reserve the right to use Anonymous Information without restriction.

DISCLOSURE OF ANONYMOUS INFORMATION

We reserve the right to disclose Anonymous Information publicly without restriction, including to third party vendors who may help us enhance or provide the Site or Services or to third parties.

OUR RELATIONSHIP WITH SOCIAL NETWORKING SITES AND THIRD PARTY DATA PROVIDERS

We have created and may offer you interfaces that allow you to connect with social network (“SN”) websites such as, but not limited to, Facebook through our Web Site and Service. We will work with their application protocol interface (better known as their developer API) in a way that allows you to authorize us to access your account on that SN Service on your behalf. In order to provide this authorization, you will not provide us with your user ID or password to the SN, but you will need to log-in to that SN directly through our Site. Once authorized by you, the SN will provide us a token that allows the SN to recognize us when we ask, on your behalf, for access to your account information or to post information. You will be able to revoke our access to any SN at any time by amending the appropriate settings from within your account settings on the applicable SN, though such revocation may limit the Services we are able to provide you.

In addition to accessing your SN accounts through Developer APIs, we may also offer interfaces that allow Developers to connect with APIs for SN as well as other third party data providers in a manner that allows a Developer to retrieve data from such third parties for inclusion in a Developer’s App, for example Facebook or Google Maps (collectively, “Third Party Data Providers”). We may connect Apps to such APIs using the token method discussed above or we may require that a Developer provide us the applicable API key, user name, password or other method of authentication (the “Third Party API Access Protocols”). The Third Party API Access Protocols will be disclosed and used in the same manner as Personal Information, with the understanding that they will not be used to market any products or services.

CANCELLATION OF ACCOUNT

Please note that even though you may cancel your account or in other ways request the deletion of your Personal Information by us, we may be required (by law or otherwise, such as to prevent fraud, resolve disputes, troubleshoot problems, or enforce our Services Agreement) to keep this information and not delete it (or to keep this information for a certain time) in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete Personal Information, it will be deleted from the active database, but may remain in our archives and we may also retain Anonymous Information about your use of our Services. Once we disclose some of your Personal Information to third parties, we cannot access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.

DISCLAIMERS

The use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. The Site may contain links to third party websites, services or content not owned or controlled by us, but may be integrated into your Apps. When you click on such a link, you will either leave our Site and go to another site, or you will be asked to agree to such third party’s terms and privacy policy before integrating such third party’s content or services into your App. If you leave our Site, another entity may collect Personal Information or Anonymous Information from you. We have no control over, do not review and are not responsible for the privacy policies of or content displayed by such third parties. Please review the privacy policy of any new website you visit.

We employ reasonable physical, electronic and managerial security methods to help protect against unauthorized access to Personal Information. However, no data transmission over the Internet or data storage facility can be guaranteed to be perfectly secure. As a result, while we try to protect your Personal Information, we cannot ensure or guarantee the security of any information you transmit to us, and you do so at your own risk.

These policies are inspired by the policies of Parse, Kinvey ,  Google App Engine and Heroku. The original works have been modified. Apptimate is not affiliated with any of these companies or services.

CHANGES TO THIS STATEMENT

Apptimate reserves the right to modify or update this policy statement at any time without notice.
